
Babakar from Saudi Arabia had bought and gifted 50 crores worth of land to the Muslim community to build a mosque, and some Ulmas had made some changes to the original document had tried to usurp it. People of Dehiwala had been revealing some secrets regarding this matter.
The people of Dehiwela had registered cases against the expropriation and sale of this property in the District Court of Justice and in the Appellate Court against the Waqf council because the Waqf council did not implement its efforts to register it as a Waqf property and a mosque for many years. In addition, the Mahalla residents continued the public case to appoint nine persons as trustees of the mosque to be registered.
In both these cases it is the usurpers argued that it is not a mosque but a personal property.
Last October 27 The Court of Appeal, after examining the plea and evidence of the public decided that it is public property, and it ordered the Ministry of Culture to register it as a mosque as a waqf property and fulfill the demand of the public. In the presence of the Hon'ble Court, the Muslim Departments humbly agreed to fulfill the demand of the public.
In this case, the relevant departments promised to fulfill the public's request before the court, and the Waqf council and the Cultural Department were given time to fulfill the public's request and postponed the case with the permission of the public's side, and in case of failure to fulfill this, the case will be continued again, conditionally, in the presence of the court, it is significant that the case was adjourned.
While the court had to raise objections from the Department of Culture, and the Attorney General's Department, both sides willingly agreed to the request of the petitioners, and the Court of Appeal allowed this decision before the court. This decision allowed the public side. Accordingly, the court temporarily adjourned the case.
And while the Minister of Culture is named as the fourth defendant in this case, he had already issued a letter to the director to conduct an inquiry against those who registered the mosque and tried to sell it.
In this case, the court had ordered the Department of Culture to take into consideration the order of the minister, who is the fourth defendant in the case, and to implement them.
Subsequently, the concerned councils and the Department of Culture dragged their feet without complying with the court's order, allowing the extortionists to escape.
As a result, even though the petitioners' counsel tried to obtain a report regarding the implementation of the court's order in order to resume this case, the counsels of the Ministry of Culture are avoiding opportunities.
Amidst this, the Waqf Council registered it as a mosque on December 6.
Also, without appointing the public who had requested through the public court as trustees, on the 5th of December, the powers and responsibilities were written in the name of the usurpers through a trust, and it was registered at the Telkandha Land Registrar's Office on the 6th of December. It was handed over to the director of the ministry by the usurpers on the same date, signed by the director on the same date, submitted to the Waqf council by the director on the morning of the same day, and at 10.30 am on the 6th of December, the Waqf council approved the trust and submitted it for the approval of the Waqf Court.
While the public had requested for certain documents under the Right to Information Act ,It has been four months since the public applied for them and they are yet to be distributed to the public. The law says they must be issued within two weeks of application. Hence it has also been brought to the attention of the Information Commissioner regarding the unsatisfactory action of our Muslim cultural authorities.
The usurpers have made the Trust No. 1139 invalid on the 6th of December which enabled to sell the land and have written and registered Trust No. 2207 in their favor on the same day.
As they already failed in the case to steal the land, they had re-empowered the usurpers through a trust by giving them a backdoor entry. The Waqf Council has sanctioned the usurpers in violation of the order of the court this engaging in contempt of the court.
Also, while two cases are going on related to land and a controversial trust, the Ministry of Culture and Waqf council have given permission to a new trust named 2207 without the permission of the court by deactivating the trust 1139, which is in dispute in the cases, without the permission of the court, and the facts of the 1139 trust, which is in dispute in the court were hid.
Therefore, in front of the Waqf Council at 3 o'clock in the afternoon on the 10th of next Wednesday, the public had decided to hold a demonstration against their contempt of court and corruption and bring it to the attention of the Minister of Justice and Minister of Culture.
In the same court, in the same case, those who argued that it is not a mosque in the presence of the lawyers of the Ministry of Culture, while their petition was also rejected before the lawyers of the Ministry of Culture and Attorney General's Department, while another case is going on in the Mount Lavinia district court, as to how did the Waqf Council allow these usurpers to be trustees of this same mosque when they are arguing that it is their private property?
Therefore, the Ministry of Culture, and the Waqf Council recognized the foundation of those who argued that this public property was not a mosque, and they were given a chance to usurp by other means after sometime.
Already there is an opinion that Muslims don't respect the law. In a time like this their action is fertilizing that opinion.
This is the first time in the history of Sri Lanka that a Waqf council has disrespected the court and a protest has been held against the Waqf council.
Due to the corrupt behavior of some officials of the Waqf Council and the Ministry of Culture, there have been ongoing problems in the past regarding public property and trustees of mosques.
So in this protest, all those who have been wronged by them are requested by the public to attend.
